Buying.

The Buyer shall be responsible to Eden Landscapes for ensuring the accuracy of any information provided in relation to the order (including name, full delivery address, contact details and building specification).

Buyer will need to ensure that the building Model, dimensions, configuration, extras are correct at the time of purchase. Once a building has gone into production we will not be able to change the specification or offer any refund.

Buyer must ensure that all component parts of item ordered can be delivered safely to point of installation at time of purchase.

All orders are subject to availability of the goods. If the goods are unavailable, Eden Landscapes will be at liberty to supply to the Buyer a substitute of an equivalent quality and price. In the event that Eden Landscapes are unable to supply the Product or any substitute Product we will notify the Buyer as soon as possible and reimburse any payment made.

 

Payment

Payment for goods must be made in full at time of purchase. Funds from any payment made by cheque or BACS must appear in Eden Landscapes bank account before any orders are placed with a supplier. This may have a bearing on the delivery date of product.

Payments are only accepted by the following means, cash, company or personal cheque (made payable to Eden Landscapes Ltd), BACS, Visa, MasterCard, Visa Delta and Electron, Amex

 

Prices

The prices are listed in £GBP and are inclusive of VAT. Prices are subject to delivery and installation costs.

Eden Landscapes reserves the right to increase the price of the Goods to reflect any increase in the cost to us which is due to any factor beyond our control (such as, without limitation, any foreign exchange fluctuation, currency regulation, alternation of duties, significant increase in the costs of labour, materials or the costs of manufacture). The price payable by the Buyer shall be the price in force at the time when the order is placed.

Should a pricing error occur, Eden Landscapes will inform the buyer if the price for the Goods is higher than that stated on the order. The buyer may then choose either to proceed or to cancel the order.

Any prices shown in branded literature, or on the website are provided for information purposes only, and were correct at the time of publishing. Only prices quoted at point of sale shall apply

 

Delivery

Eden Landscapes delivery times are given in good faith and are estimated, based upon information provided by the manufacturer. Delivery can occur sooner or later than the anticipated timescales.

 As Eden Landscapes is not the manufacturer of the branded products, it cannot be held responsible for delay in delivery caused by; (a) the manufacturing process, or (b) third party such as a contracted carrier (c) availability of stock.

If access for delivery is restricted please ensure that you inform us when placing your order or in all circumstances prior to despatch of the goods. Failure to do so will result in the delivery being treated as a failed delivery if access is unavailable and may result in a re-delivery charge being applied.

It is the responsibility of the buyer to provide free and unobstructed access for product delivery and subsequent installation to include vehicle access. Delivery is to a point no further than is accessible by delivery vehicle, unless previously agreed.

Please check building is complete, and not damaged at time of delivery. Please report any damage to Eden Landscapes as soon as is possible. If the goods are damage as a result of the delivery process, then please send photographic evidence to edenenquiries@hotmail.com. Eden Landscapes will replace, or repair any faulty components of your order to fulfil the initial purchase.

Our delivery service is kerb side only, unless previously agreed at time of purchase. If you have any special requirements or if access is difficult, please contact 02920 597365.

We are unable to carry buildings through a domestic property. Our drivers are not insured for such activity. In most cases the component panels of sheds/ summerhouses will NOT fit through a domestic pedestrian doorway.

In the interests of Health and Safety our bulky products will not be lifted over walls, fences, buildings etc.

Unless previously arranged, Customer must be in attendance during delivery. If items are delivered to an unattended property, Eden Landscapes will not be responsible for any loss or damage once unloaded.

Once unloaded, the buyer will take on responsibility for any loss or damage.

Eden Land will not take responsibility for loss or damage to property as a result of failing to ensure the correct delivery criteria.

Failure to comply with one or more of the above may result in an aborted delivery. In which case the product will be returned to our yard and be subject to a further delivery charge.

 

Lugarde Deliveries

In the case of Lugarde log cabins, delivery to designated address will be to kerbside only. It will be the responsibility to ensure that access is possible and clear from any obstruction. It is the responsibility of the buyer to move component parts of cabin from kerbside to a safe storage area or point of installation.

Buildings will be delivered directly from Lugarde on a 40’ Articulated Lorry and forklift. It is essential that any access issues are highlighted at time of ordering.

In the event that delivery is aborted due to failure to comply with any of the above, the building will be returned to Eden Landscapes and a further re-delivery charge will be applicable at cost to the buyer.

All the above apply to both delivery only purchases and for install including delivery purchases.

 

Cancellation

If purchased online, the customer may cancel an order from the date of purchase up to a period of 14 days of Eden Landscapes delivering the goods.

The customer may not cancel if any part of the order includes modifications or bespoke elements to a stock item.

It is the responsibility of the customer to return goods in an acceptable condition without damage or modification. Statute states that a product should be returned in its original condition, thus fit for re-sale as new. We shall therefore reject the return of any product where assembly has been commenced, thus rendering the product as 'used'.

The customer will be responsible for any return costs, by their own arrangement, or for any costs incurred by Eden Landscapes during the return process.

Any costs incurred by Eden Landscapes during the return process will be deducted from any monies owing to the customer.

If a customer has decided to purchase one of our buildings using 0% finance, then they have 14 days after signing, to cancel the  loan contract without paying a penalty. This is known as “cancellation period” If you would like to cancel the loan contract then please contact Eden Landscapes within 14 days of signing.

In respect of a bespoke order i.e. a building which has been designed to a customer’s unique specification, we are unable to cancel the order without penalty,  if the building has gone into production. The customer will be responsible for any costs incurred by the manufacturer or Eden Landscapes up to the point of cancellation, or in some cases the full cost of the building.

 

Planning Permission

It is the responsibility of the buyer to ensure that any building purchased complies with planning regulations.

Planning permission is not needed if the development matches a set of criteria - Permitted Development Rules. These are the guidelines which you can follow and if the garden building matches the criteria, planning permission will not be necessary.

Normally Planning Permission or Building Regulation approval is not required provided that:

  • Sheds and greenhouses do not cover more than half of the area of the garden; not including the area occupied by the house.
  • It contains no sleeping accommodation and the floor area does not exceed 15 square metres.
  • No point is less than one metre from a boundary.
  • It is not more than 3m high for a flat roof, or 4m with a ridged roof.
  • Overall height from ground level to ridge must not exceed more than 2.5 metres within a 2 metre range of any boundary. A building with overall height exceeding 2.5 mtrs in height and placed within 2 metres of any boundary will require planning permission.
  • Height of the eaves must not exceed 2.5 metres
  • No part projects beyond any wall of the house that faces a road.
  • The outbuilding is for use only by those who occupy the house.
  • A Log Cabin should be more than 5 metres from the main dwelling and up to 50% of the remaining garden can be utilised with this type of building.
  • No verandas higher than 30cms from ground level.
  • Building Regulations do state that structures built of combustible material (i.e. a wooden shed) must be at least 2 metres from the main house.

If at all in doubt contact your local authority for clarification.

 

Install

To ensure installation can be completed, the customer will be required to;

(a) provide a concrete , paved base or gravelled area , being firm, square (diagonals) and level (by spirit level) - no less than the size of their chosen product,

(b) ensure 600mm (2') unobstructed access is provided all around the proposed site,

(c) no trees, branches or similar encroach upon the proposed site or working space, and

(d) provide clear access to the installation site (not height or turn limited) to allow unimpeded passage of the product sections or components.

In the interests of Health and Safety installers reserve the right to refuse lifting heavy component panels over walls, fences, hedges buildings etc. if it is deemed unsafe, or may cause injury or damage to property or the product.

Access from the unloading site to installation site must be free of obstacles, hazardous or slippery surfaces and any overhead restrictions that prevent the safe placement of any of the products component panels.

If on arrival the base prepared by the customer' does not comply with any of the above then the installation team are entitled to abort installation.

In the event that installation is aborted, the product can be left for self-assembly by the customer, but the erection service fee shall be retained to account for the abortive labour costs.

Upon abortive installation, the product can be left until the customer provides an appropriate base, at which point a return installation visit can be arranged upon payment of an additional charge

It is advised that the customer is present at the time of fitting but not essential, however we would require written permission to deliver and install in the customers absence along with detailed instructions of fitting requirements.

 

Rectifying Defects

Please note: timber is a natural product and prone to changes in appearance, some movement, warping and splitting, particularly in extreme weather conditions is natural and to be expected. Knots in timber products are to be expected. These will not affect the structural integrity of the product – this is natural and is not covered by a guarantee.

Please note that any problems that occur due to the natural properties of the materials are not defects. We will request clear photos to illustrate the reported defect and its cause so that we can determine the means to rectify it prior to any rectification. This may involve taking photos of parts of your product which you believe are unconnected to the defect but which may nevertheless be the cause of it.

If a defect occurs which is the fault of Eden Landscapes, we will give you appropriate options which may include replacement, repair or partial refund.

Where the defect is deemed to be the customer’s fault for any reason e.g. unsuitable base/site, poor maintenance, incorrect or poor installation, use of defective materials supplied by the customer or misuse of the product, any rectification will be chargeable to the customer.

If you do not give us a reasonable opportunity to rectify any defect we will not reimburse you if you choose to rectify it yourself or with a third party.

 

Guarantee

We endeavour to install our garden buildings to the highest standards, and follow manufacturers specifications at all times. In the event that any defect occurs to the building as a result of our installation procedure, we will rectify any issue resulting from this up to a period of 6 months from the date of installation.

Manufacturer’s warranties are applicable to the products provided. Please refer to relevant manufacturers’ website/ literature for terms and conditions.
